Welcome to Kismets. These Terms of Service ("Terms") govern your access to and use of the website kismets.ai, related domains, and the digital products and services provided by Kismets (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility

The Service is intended for users who are 18 years of age or older. By using Kismets you represent and warrant that you are at least 18 and have the legal capacity to enter into a binding agreement. If you are not, please do not use the Service.

2. What Kismets Is — and Is Not

Kismets is a reflective digital tool inspired by classical Chinese metaphysics (Bazi/八字), informed by frameworks from modern psychology (including Jungian archetypes and attachment theory). All reports are generated by our Bazi inference engine and refined by human editors, and are intended for personal reflection, cultural exploration, and entertainment.

Kismets is not:

• Fortune-telling, prediction of future events, or guarantee of any outcome.
• Medical, psychiatric, psychological, or therapeutic advice.
• Legal, financial, tax, or investment advice.
• A substitute for professional services. If you are experiencing emotional distress or facing a serious decision, please consult a qualified licensed professional.

3. Your Information and Accuracy

To produce a report, you provide birth information (date, time, and optionally place). You are responsible for the accuracy of this information. If your intake is incomplete or inaccurate, the resulting report may not reflect what you intended. We do not verify or validate user-submitted information.

4. Payments

Payments are processed by our payment provider, Lemon Squeezy (or a successor processor we designate). All prices are listed in U.S. dollars. The applicable taxes and currency conversion fees, if any, are handled by the payment processor as merchant of record. By completing a purchase, you authorize the charge and agree to the processor's terms.

5. Refunds

Refund handling is described in our Refund Policy. In short: this is a hand-checked digital product, so we do not operate a no-questions-asked refund window. If something is genuinely wrong with your report, reply to the delivery email and we will work with you — revision, clarification, or refund, depending on the situation.

6. Intellectual Property

The Service, including the Bazi inference engine, rule library, prompt structures, designs, and written content, is the property of Kismets and its licensors. You may use the report we deliver to you for your personal, non-commercial reflection. You may not republish, resell, scrape, or train other AI systems on Kismets content without prior written permission.

7. Acceptable Use

You agree not to:

• Use the Service to make decisions about medical, legal, financial, or safety matters.
• Submit information about a third party without their knowledge and consent.
• Attempt to disrupt, reverse-engineer, or probe the Service's infrastructure.
• Use the Service in violation of any applicable law in your jurisdiction.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, Kismets shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising from or related to your use of the Service. Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the twelve (12) months preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date at the top and, where appropriate, notify you by email or via the Service. Continued use after changes means you accept the updated Terms.

11. Termination

We may suspend or terminate your access to the Service at our discretion if you violate these Terms or if we discontinue the Service. Reports already delivered remain yours to keep.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of these Terms will be resolved in the state or federal courts located in Delaware, unless another forum is required by applicable consumer-protection law.
